Details of retention periods for different aspects of your personal data are available on request by contacting us using the details above. Your legal rights Under certain circumstances, you have rights under data protection laws in relation to your personal data, as follows: Request access to your personal data. This is commonly known as a “data subject access request” and enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it. Request correction of your personal data. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us. Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request. Object to processing of your personal data. Where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms. Request restriction of processing your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios: (a) if you want us to establish the data's accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it. Request transfer of your personal data. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you. Right to withdraw consent. Where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain services to you. We will advise you if this is the case at the time you withdraw your consent. If you wish to exercise any of the rights set out above, please contact us. You can find out more about these rights by viewing the ICO’s guidance here: https://ico.org.uk/for-organisations/guide-to-data-protection/guide-to-the-general-data-protection-regulation-gdpr/individual-rights/. No fee usually required You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances. What we may need from you We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response. Time limit to respond We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

We may also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data may be derived from your personal data but is not considered personal data under data protection law, as this data does not directly or indirectly reveal your identity. For example, we may aggregate data about your use of the website to calculate the percentage of users accessing a certain section of our website. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this Privacy Policy. We will not collect or process special categories of personal data (as defined in the Glossary) about you at any time. We will generally use your personal data to: Help us to identify you when you contact us; Contact you by post, e-mail and telephone and via social media regarding the products or services, and/or the information that you have requested from us; Provide the products and services that you have purchased from us; Provide you with information regarding our Partners; Personalise your experience on our website and in providing our products and/or services to you, and to provide information and contacts relevant to you and your business (where applicable); Provide you with any publications or marketing material produced by us or our Partners, where you have requested to receive such material; Develop and provide new products and services to you; Respond to any enquiries you submit to us; Create and administer your account on our website; Allow you to participate in any interactive features on the website; Display your details in any case studies and/or testimonials which we publish on our website, where you have consented to this separately; Process financial transactions (including collection of payments, management of any additional charges and fees and administration of any refunds); Generally administer our relationship with you, and any order you place for our products and/or services; Keep a record of your relationship with us; Prevent and detect fraud; Comply with our legal and regulatory obligations; Provide service and support (including investigating complaints); Train our staff and carry out quality control; Review and improve our services or our products; Use data analytics to improve this website, our marketing, client relationships, user experience and our organisation in general; and Administer and protect the website and our organisation (including troubleshooting, data analysis, testing and system maintenance and network security). Lawful basis for using your information In some cases, we will only use your personal information where we have your consent or because we need to use it for the performance of a contract with you (for example, because you have ordered products or services from us). Generally, we do not rely on consent as the lawful basis for processing your personal data, although we will get your consent before sending third party direct marketing communications to you. You have the right to withdraw consent to marketing at any time by contacting us, or by checking or unchecking relevant boxes on our site, or in our communications to you, to adjust your marketing preferences. Where you opt out of receiving marketing messages from us, this will not apply to personal data provided to us as a result of a purchase by you of our products and/or services, any warranty registration, any experience you have had with our products and/or services, or any other transactions you have undertaken with us. There are other lawful reasons that allow us to process your personal information and one of those is called “legitimate interests”. This means that the reason that we are processing information is because there is a legitimate interest for us to process your information to help our business. Whenever we process your personal data on the basis of a “legitimate interest”, we make sure that we take into account your rights and interests and will not process your personal information if we feel that there is a disproportionate privacy impact on you. Marketing If you are a consumer, we will only contact you by e-mail for marketing purposes if you have given us your opt-in consent to do so. This may include information about products and/or services offered by us that are similar to those that we have already provided to you or that you have requested us to provide to you, to notify you about changes to our products or services, or any other information which we have a legitimate interest to contact you about, unless you have asked us not to do so. You can manage your preferences at any time by contacting us using the details set out below. Please note that we will continue contacting you about information that is connected to the contract that you have with us, including the provision of any products, or the performance of the services that you may have purchased from us, or our other products or services you may have requested from us. We will not share your information for marketing purposes with any company or other entity (including our Partners) unless we have your opt-in consent to do so. You can ask us or third parties to stop sending you marketing messages by contacting us at any time or by clicking the “unsubscribe” button in the relevant e-mail. Change of purpose We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us. If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so. Please note that we may process your personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law. Disclosures of your personal data We may have to share your personal data with the parties set out below for the purposes set out in paragraph 6 above. Any suppliers, sub-contractors, agents and other third parties which may help us with the provision of the products and/or the services that you have requested from us. Service providers who provide IT, security, software and system administration services. Any designers who are involved in making changes to the design of the website, or any of our publications or marketing material (where you have consented to receive such material). Any organisations that from time to time provide hosting services for our website. Professional advisers acting as processors or joint controllers including lawyers, bankers, experts, accountants, insurers and other third parties based who provide legal, banking, consultancy, accounting, insurance and other related services. HM Revenue & Customs, regulators and other authorities acting as processors or joint controllers based in the United Kingdom who require reporting of processing activities in certain circumstances. Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses, carry out a restructure or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this Privacy Policy. Any other entities which are under the same beneficial ownership as us that may subsist from time to time. We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers, or our Partners, to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions. We do not and will not sell your personal data to any third party. International transfers Some of our external third parties may transfer your person data outside the UK. For example, our website is provided by Wix.com Ltd, who may store personal data which they receive from us in their data centres in the United States of America, Ireland, Japan or Israel. For more information on how Wix.com Ltd stores personal data, please see their privacy policy at: https://www.wix.com/about/privacy. Whenever we transfer your personal data out of the UK, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented: We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data. Where we use certain service providers, we may use specific contracts approved for use in the UK which give personal data the same protection it has in the UK. Data security We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality. We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so. The Website may include third-party advertising and links to other websites. We do not provide any Personal Data to these advertisers or third-party websites. We cannot accept responsibility for any unauthorised access or loss of personal data that is beyond our reasonable control and we exclude all liability for loss that you may incur when using third party websites. Data retention We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

JB Data Engineering works with Human Performance Visonaries and industry specialists to deliver solid improvements in areas such as Fitness and Stamina, Diet and Sleep, Media and Mental Approach. These techniques are dovetailed to work in conjunction with the driver track strategies thereby delivering a holistic approach. Human Performance Engineering VIDEO ANALYSIS Video analysis has become an extremely popular service with drivers at all levels finding this tool helpful in understanding visually where they could improve their lap-times. Video analysis is particularly useful where an amateur driver is working with a driver-coach, who is then able to identify where improvements in times can be made. Racelogic’s Circuit Tools data analysis software and Aim’s Smartycam video software provides the capability to run multiple laps side-by-side. This facility allows the driver to see vehicle data alongside video of the lap. Using GPS to plot the driver’s lines, a coach can quickly understand and explain where the lap-time can be improved. Video Analysis RACE & FUEL STRATEGY JB Data Engineering can provide race and fuel strategies to teams and individual drivers, a crucial planning tool particularly when competing in endurance events. Thanks to JB Data Engineering’s experience in race strategies, planning time is reduced. Our race/fuel strategies include run-plans for each session with fuel usage per lap and per session and can record sector-times, lap-times, driver stint-times, session duration and session-elapsed time. Our strategies have been used in the 24H Series, the British GT Championship and the VW Fun Cup 25 Hour Race at Spa-Francorchamps.
